Terms & Conditions

Repair Agreement:

FMA Repairs will repair your device as described for the charges stated and written on the quotation or invoice provided to you, (unless charges are changed through your oral or written approval). If the device is under the FMA Repairs warranty, FMA Repairs will perform maintenance and repairs under the terms of the warranty, with the correct proof of the device’s eligibility for such maintenance and repairs. You will be accountable for any supplemental charges that apply to your device’s warranty.

 

 Payment: All charges must be paid in full when the device is given back to you. The assessed amount includes all parts, labor and certain transportation necessary for the repairing of the device plus any applicable tax, unless stated otherwise. FMA Repairs may charge you for a consultation fee, plus any applicable tax, if FMA Repairs examines your device, provides an assessed price for you, and you do not approve Fix My Apple to undergo the repairing for the assessed charges. If FMA Repairs concludes, while examining your device that repairs are needed due to lack of parts that are not provided by FMA Repairs or are necessary due to harm caused by misuse or maltreatment, FMA Repairs reserves the right to give the device back to you without any repairs and may hold you accountable for consultation fee and any applicable tax.

Consent

If the repairs you have asked for require work/labor and/or parts not specified in the agreement, FMA Repairs may revise the estimate with your approval. If you refuse that FMA Repairs may change the charges, FMA Repairs may give you back your device and hold you accountable for the consultation fee, plus any applicable tax.

Parts

When repairing your device under FMA Repairs' warranty, FMA Repairs may utilize new, used or refurbished parts. If repairing parts outside of warranty, FMA Repairs may utilize new, used or refurbished parts. FMA Repairs will keep the recalled part that is exchanged under the repairing service as its property, and the replacement part will become your own property. Replaced parts are usually fixable and are exchanged or repaired by FMA Repairs for value. If any applicable law requires FMA Repairs to give back a replaced part to you, you consent to pay FMA Repairs the supplementary cost of the replacement part.

Affiliation with Apple

FMA Repairs is not affiliated with Apple, Inc and is not an Apple Authorized Service Provider. Due to the non-affiliation, FMA Repairs cannot recognize or honor any Apple warranty. Our employees may have Apple Certifications and are knowledgeable and capable of performing repairs on Apple Products, Apple does not recognize FMA Repairs as an Apple Authorized Service Provider. Despite equal and comparable workmanship, any device that is not repaired by Apple or its affiliates may be considered tampering and affect their warranty coverage.

Warranty Coverage

FMA Repairs fixes your device under FMA Repairs’ warranty, the repairs will be covered only by the terms of the warranty and applicable provisions of law. If your device is repaired outside of warranty, FMA Repairs authorizes (1) that the repairs will be done in a skilled and proficient way and (2) that all parts used to repair your device will be free from defects in materials and workmanship for 90-days excluding any adhesives or glues used to bond or re-seal devices as rapid temperatures changes may cause it to separate and any damages caused to the device from the adhesive or glue separating is not covered under any warranty whatsoever and we will not be held responsible for damages. This also does not include hard drives, headphone jacks, batteries, power buttons, volume buttons, and any parts repaired due to liquid damage. The warranty on parts is an express limited warranty. If a defect exists in a replacement part during the part’s warranty period, at its choice, FMA Repairs will (1) repair the part, using new, used or refurbished replacement parts, (2) restore the part with a new, used or refurbished equivalent part, or (3) refund the fair market value of the part, as decided by FMA Repairs.THIS WARRANTY AND REMEDY ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, WITH RESPECT TO THE REPAIR PARTS. FMA REPAIRS SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES WITH RESPECT TO SUCH PARTS, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF FMA REPAIRS CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS LIMITED WARRANTY.

Use of Contact information

All customers serviced by FMA Repairs or entities affiliated in business practices are subject to their contact information to be used solely for promotional use by FMA Repairs for the services provided only by FMA Repairs unless/otherwise by stating to be opted-out via email.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FMA REPAIRS AND ITS AFFILIATES, WILL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM PERFORMANCE OF ANY REPAIR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE; ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF DATA; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, OR CORRUPTION OF DATA; OR ANY COSTS OF RECOVERING, PROGRAMMING, OR RESTORING ANY PROGRAM OR DATA STORED OR USED WITH YOUR PRODUCT AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON YOUR PRODUCT. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS. FMA REPAIRS SPECIFICALLY DOES NOT WARRANT THAT IT WILL BE ABLE TO (i) REPAIR YOUR PRODUCT WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA, AND (ii) MAINTAIN THE CONFIDENTIALITY OF DATA.

  

  If any device should be mishandled and broken while in FMA Repairs' keeping, FMA Repairs will make an effort to fix the damage done by means of repair. FMA Repairs' liability will be limited to the cost of the repair-affected component. If a device cannot be fixed or restored to its original state of functionality during the duration of FMA Repairs' keeping, FMA Repairs will in good faith attempt to resolve the issue for the customer.

 

 *FMA Repairs will not be accountable for any devices that show evidence of the following:

  *Liquid Damage – FMA Repairs is not accountable for any devices which show evidence of liquid damage or has been exposed to liquid. If any product exhibits proof of liquid contact or damage from liquid contact, FMA Repairs cannot guarantee the device will be returned in the same state or level of functionality prior to any service. Liquid damage is not covered by FMA Repairs' warranty.

  *Data Loss or Corruption – FMA Repairs is not accountable for loss or distortion of data or your restricted, proprietary or personal information or removable data. Prior to bringing in your device for repairing, make a backup copy of data and remove any restricted, proprietary or personal information and removable media such as Compact Disc, USB drives, etc...

  

  OTHERWISE, FMA REPAIRS' LIABILITY FOR ANY AND ALL DAMAGE SHALL IN NO EVENT EXCEED THE PAYMENTS RECEIVED BY FMA REPAIRS FOR SERVICES POVIDED PURSUANT TO THESE TERMS. THE REMEDIES SET FORTH HEREIN SHALL BE YOUR SOLE AND EXCLUSIVE REMEDIES FOR ANY BREACH BY FMA REPAIRS UNDER THESE TERMS AND CONDITIONS.

Product Abandonment

If you do not claim your device and pay all charges within thirty (30) days after notification via SMS or email from FMA Repairs that your device has been repaired or irreparable, FMA Repairs will deem your device abandoned. FMA Repairs will notify you at the phone number or email you provided when you authorized the repairing. FMA Repairs may dispose of your device in accordance with applicable provisions of law, and specifically, may recycle or sell your product at a private or public sale without legal responsibility to you. FMA Repairs reserves its statutory and any other lawful liens for unpaid charges.

Software & Data Usage

In the event that FMA Repairs requires transferring information or installing software, you have the legal right to copy the information and agree to the terms of the software license, and you permit FMA Repairs to transfer the information and accept such terms on your behalf in performing the service. Software installments and repairs are not covered by FMA Repairs' warranty.

You consent and comprehend that it is necessary for FMA Repairs to collect, process and use your data in order to do the repairs and service obligations under these Terms and Conditions. FMA Repairs will secure your information in accordance with FMA Repairs' Customer Privacy Policy

General Terms

These Terms and Conditions are the only ones that govern FMA Repairs the repair of your product. No other oral or written terms or conditions apply, including ones in any purchase order that you provide to FMA Repairs. No one has the authority from FMA Repairs to vary any of these Terms and Conditions.
